While watching over Itachi and Shisui's spar, and having Amaterasu in his hands, Fugaku didn't notice a kochū(worm insect) that bit him.
Worm insects are very common in the world, especially in Land of Fire. Especially near lakes. They are mostly harmless, and are microscopic enough that they live on humans and feed on excess oil and dead skin cells.
If one isn't looking for it, even Fugaku wouldn't notice it.
Yoji Aburame has these insects in him, which are slightly bigger than normal and have poison potent enough to be as lethal as a scorpion.
He was abused by his father, who was jealous of his talent. When he accidentally dropped some water on his father, his father almost slit his throat, and Yoji was only able to come out alive by killing his father.
Then, he was taken in by Danzo. Root name: Sugaru.
He had sent him to academy to keep a close eye on his classmate, Itachi.
Danzo wouldn't have used the kid's ability so soon, given that the poison can be traced back to Aburame clan. Sugaru hasn't cultivated new worm insects whose poison will break down and become untraceable.
But he is desparate enough to kill Amaterasu. But first, he needs his eyes. He doesn't want a pair of Mangekyo Sharingan to go to waste.
That's why, Sugaru's insects will sneak into the Uchiha clan through Itachi. And when he is close to Amaterasu and Fugaku, those insects will sense their smell and kill them when it's female counterpart is near it, which Orochimaru has on himself.
Meanwhile, Orochimaru, who has sneaked into the Uchiha clan by wearing Uchiha Kiyama's skin will get the Mangekyo Sharingan before the poison spreads to them.
The plan was meticulous. But Danzo failed to see something.
Orochimaru planned to betray him right now. He didn't care that Danzo has blackmail material on him about his experiments for immortality.
Orochimaru knew that Danzo will betray him once he isn't useful to him anymore. Danzo wants Wood Release. But what about now that there is a pair of Mangekyo Sharingan?
And as if Orochimaru will just let that useless Danzo kill his precious test subject and possible future vessel just like this.
After the insect bit Fugaku and his senses dulled, 'Uchiha Kiyama' who had been nearby came instantly and sprayed a special bug spray that keeps that type of insect away on both, before the insect could bite Amaterasu.
It had a side effect of immense sleepiness.
Shisui and Itachi noticed this, but were too slow to do anything. Orochimaru summoned snakes to keep those kids busy.
Fugaku's condition wasn't good. And before he could activate his Sharingan, Orochimaru swiped the kid from his hands and started fleeing, using Amaterasu as a shield against any attack.
Fugaku's chakra was haywire, so he couldn't cast a genjutsu powerful enough to stop him. Shisui freed himself from the snakes, and tried to use Kotoamatsukami to save Amaterasu, but by then, one of Orochimaru's snake had reverse summoned him.
After Minato, no one is better at escaping than Orochimaru.
Ideally, he wouldn't have been able to get away if Fugaku was not poisoned and then gassed. But in ninja world, people don't play fair.
"Damnit! Shisui! Itachi! Inform the whole clan to hunt Orochimaru! Don't waste time on Kiyama! We must save Amaterasu at any cost!"
Meanwhile, Orochimaru was now in Ryuchi cave, glaring at the snakes eyeing the baby to get them to back off.
Aside from him, only Hiruzen knows where Ryuchi cave is. But bringing a baby here for long isn't good.
So he decided to immediately go to his base in Land of Grass secret base that he established during the Third Ninja War after realising that Hiruzen was favouring Minato to become the Fourth Hokage.
He quickly administered the antidote of the bug spray and headed to his base. It isn't an ideal place, given that Kusa is Konoha's puppet, but for now, that will do.
He smirked at the unconscious child.
"I saved you from getting assassinated. You better be obedient to me."
Saying that, he licked Amaterasu with his long tongue.
